WANG Yuantian- The Familization of Land and Its Origin in Modern England

Abstract

From the 17 th to the 19 th century, the phenomenon of land familization prospered in England.Landowners split their land rights and redistributed them among family members to ensure that the land would be inherited inside the family from generation to generation.The pursuit of land familization had long been obstructed in the feudal ages.As a result, people failed to construct family land on the foundation of family community, yet they found an alternative solution from their tradition of valuing individual right.The process of land familization and land privatization progressed together in England, while the construction mode of family land was an important phased embodiment of the process of land privatization.The land familization mode based on individual right highly relied on land privatization and the legal protection for individual right, which was totally different from the situation in ancient China.It will provide us a perspective of the other with the reference of the construction mode of family land in Chinese history, so that we can understand the phenomenon and origin of land familization in modern England more profoundly.
